Can you bring your fiancé to the United States?

Long-distance relationships aren’t easy, but when two people are committed to each other, they find ways to make it work. Now that you’re a U.S. citizen, you are looking forward to bringing your fiancé to the United States so you can begin your life together.

Fortunately, the U.S. government allows its citizens to petition for a K-1 fiancé visa so that a person can enter the country legally to marry their fiancé. However, the process can be complex, and it’s crucial to follow the proper procedures.

Who qualifies for a K-1 visa?

To be eligible for a K-1 visa, you and your fiancé must meet specific requirements, including the following:

  • You must be a U.S. citizen. Permanent residents (green card holders) are not eligible to sponsor a fiancé under a K-1 visa.
  • Both of you must be free to marry. If either of you were previously married to someone else, it must be legally ended through death, annulment or divorce.
  • You must have been together in person in the last two years. However, there are some exceptions for cultural and religious reasons.
  • You must marry within 90 days of your fiancé’s arrival in the U.S.
  • There must be evidence of a genuine relationship, such as photos, correspondence and statements from friends or families.

The process begins when you file an I-129F form (Petition for Alien Fiancé) with the U.S. Citizenship and immigration Services (USCIS). If it’s approved, the case is then forwarded to the National Visa Center (NVC) and then to the U.S. Embassy or consulate where your fiancé lives.

Your fiancé needs to complete Form DS-160, submit the supporting documents, undergo a medical exam and attend an interview at the embassy or consulate. If they’re approved, your fiancé will receive the      K-1 visa and can travel to the United States. Once they arrive, the 90-day countdown to the marriage begins.

What happens after the marriage?

Once you are legally married, your new spouse can apply for their green card. However, if you don’t get married within the 90-day timeframe, your fiancé’s visa will expire, and they must leave the United States. Failing to do so can result in serious consequences, including future visa denials.
