Extraordinary ability for employment-based immigrants

If you have extraordinary ability in the sciences, arts, education, business or athletics, you can apply for an employment-based, first-preference visa. You must be able to demonstrate you have extraordinary ability to be eligible.

But what does it mean? And how can you prove it?

Level of expertise 

According to federal regulations, extraordinary ability means a level of expertise that indicates an individual is one of a small percentage who have risen to the very top of their field in the sciences, arts, education, business or athletics.

How do you prove it?

To demonstrate you have extraordinary ability, you need to submit evidence that you have sustained national or international acclaim and that your achievements have been recognized in your respective field of expertise. 

Examples of recognized awards include the Nobel Prize, the Pulitzer Prize, a Grammy Award, an Oscar and an Olympic medal. These are one-time achievements that are strong enough to show expertise.

If you don’t have a major international award, the U.S Citizenship and Immigration Services (USCIS) will allow you to prove extraordinary ability using at least three forms of alternate evidence. Examples include:

  • Receipt of lesser nationally or internationally recognized prizes or awards
  • Membership in associations that require outstanding achievements
  • Published material about you in a professional or major trade publication or other major media relating to your work 
  • Evidence of participation as an individual or on a panel as a judge for the work of others in your field
  • Evidence of your original contributions of major significance in your field
  • Evidence of serving in a leading or critical role for reputable organizations or establishments, and so forth
